Protecting  the security and privacy of your Personal Information is important to  Wi-LAN and to the way we conduct our business in compliance with laws  on privacy, data protection and data security in the countries in which  we maintain web sites. We hope the policy outlined below will help you  understand what information Wi-LAN may collect, how Wi-LAN uses and  safeguards that information and with whom we may share it. WHAT INFORMATION DO WE COLLECT?

Non-Personal Information Collected Automatically

When  you access our web sites, we may automatically (i.e., not by  registration) collect technical information that is not  personally-identifiable (e.g., type of Internet browser and computer  operating system used, domain name of the web site from which you came,  number of visits, average time spent, pages viewed). We may use this  information to measure the use of our web sites and improve their  content. Wi-LAN makes no attempts to link this technical information to  the individuals visiting our web sites, unless such linking is required  in order to investigate a breach of security.

"Cookies" – Information Placed Automatically on Your Computer

In  order to use certain areas of our web sites, we store some information  on your computer in the form of a "Cookie". A Cookie is assigned to you  when you log in or set up a new account and is placed on your computer  for programming purposes only. This is a temporary or session Cookie  that uniquely identifies you as you move from page to page on a site.  The Cookie is destroyed as soon as you close your browser and is never  redirected to any other servers outside of Wi-LAN.

Personal Information

Through  our web sites, Wi-LAN will not collect any personally-identifiable  information about you (e.g., your name, address, telephone number or  e-mail address ("Personal Information")), unless you voluntarily choose  to provide it to us (e.g., by registration, placing a product order,  forwarding an employment inquiry or a copy of your resume or completing  a survey). If you do not want your Personal Information collected,  please do not submit it to us.

Children

No  Personal Information should be submitted to Wi-LAN's web sites by  children without the consent of their parent or guardian. Wi-LAN  encourages all parents or guardians to instruct their children in the  safe and responsible use of their Personal Information while using the  Internet. Wi-LAN will not knowingly collect or use any Personal  Information collected from children for any purpose whatsoever,  including disclosure to third parties.


HOW DO WE USE YOUR INFORMATION?

Customers  requesting information, Products and/or Services may be asked to  provide Personal Information. When you do provide us with Personal  Information, we usually use it to respond to your inquiry, process your  order or provide you access to specific account information. Also, to  support our customer relationship with you:

  • we  may store and process Personal Information and share it with our  worldwide Affiliates to better understand your business needs and how  we can improve our Products and Services; * For the purposes of this  Privacy Policy, the term "Affiliate" means any corporation, company or  other entity effectively controlling or controlled by Wi-LAN or  associated with others under common control or ownership, and includes,  but is not limited to subsidiaries.
  • we  may (or a third party on our behalf) may use Personal Information to  generate statistics and aggregate reports for internal use; or
  • we  (or a third party on our behalf) may use Personal Information to  contact you about a Wi-LAN offer in support of your business needs or  to conduct online surveys to better understand our customers' needs and  profiles.

If  you choose not to have your Personal Information used to support our  customer relationship (especially direct-marketing or market-research),  we will respect your choice.

Persons  interested in employment opportunities with Wi-LAN may make inquiries  through our web sites or forward to us their resumes or Personal  Information about their interest, skills and experience. We ask that  such persons immediately contact us should they wish us to remove this  information from our records. All such records are maintained by our  Human Resources department and are kept in a secure location  inaccessible to other Wi-LAN employees.

We  do not now (and do not intend to) sell, rent or otherwise market your  Personal Information to third parties. We limit the collection, use,  retention and disclosure of your Personal Information to that which is  reasonably necessary for these purposes. By using our web sites or  submitting Personal Information to Wi-LAN, you consent to our  collection from, verification with and communication to any third party  for these purposes. You consent to the collection, use, disclosure and  processing of your Personal Information by Wi-LAN and its affiliates,  and their respective agents and service providers, for the purposes set  out in this Privacy Policy.

Your ability to opt-out

We  may communicate and disclose your Personal Information to our  affiliates and other third parties to offer you other products and  services that may be of interest to you unless you notify us of your  intention to opt-out. If you do not want Wi-LAN to share your Personal  Information with our affiliates or third parties for the purpose of  offering you other products and services, please notify us by sending  an e-mail to wmiddleton@wi-lan.com  and  ensure that you include "Opt-Out" in the subject matter field of the  email, or by contacting our General Counsel at 11 Holland Avenue, Suite  608, Ottawa, Canada K1Y 4S1. It may take approximately 7 days for your  opt-out request to become effective.

Occasionally,  we will send you e-mail communications with information which may be  useful to you, including information about our Products and Services or  about offerings from Wi-LAN and our affiliates or third parties. We  will include instructions in our e-mail messages on how to unsubscribe  if you decide you do not want to receive any future marketing or  promotional e-mails from Wi-LAN However, if you are a customer of  Wi-LAN, to ensure that you receive important customer service  information, you agree that we may continue to send you non-marketing  related information when necessary.


HOW DO YOU ACCESS AND UPDATE YOUR INFORMATION?

You can access the Personal Information we hold about you by sending us an e-mail at wmiddleton@wi-lan.com.  We will advise you in advance of any charges for copies of your file.  We may be unable to provide you with some information in certain  circumstances, such as if the information also refers to other  individuals, is subject to legal privilege, contains confidential  information, cannot be retrieved using your name or account number, or  as otherwise permitted or restricted by law. If you wish to notify us  of any changes to your Personal Information, or if you believe that any  information we hold about you is inaccurate or incomplete, please send  us an e-mail with the corrections to wmiddleton@wi-lan.com.


HOW IS YOUR INFORMATION STORED?

Wi-LAN  strives to provide you with secure means of communication with us. To  facilitate secure communications, some of our web servers are secured  with Entrust digital certificates and support Secure Socket Layer (SSL)  encryption. Wi-LAN web addresses that support SSL encryption are  prefixed with https:// and your web browser may also inform you that  you are connected to a secure web page.

Information  entered elsewhere on our web sites is transmitted to Wi-LAN servers  unencrypted, using standard internet protocols (e.g. HTTP, SMTP). You  should be aware of the inherent risks of interception when  communicating online without encryption.

The  account information you provide when registering with Wi-LAN is stored  in our secure databases as long as you are a customer of Wi-LAN. You  must notify Wi-LAN if you no longer want your information to be  retained by us. If you contact us with a question or comment, any  information identifying you is only kept long enough for us to provide  you with a response, unless we are required to keep it for a longer  period of time, in which case we will notify you.

Please  note that it may be impossible to delete your information completely  without some residual information remaining in the backups.


WHAT IF WE CHANGE OUR PRIVACY POLICY?

Wi-LAN  reserves the right to modify or supplement this Privacy Policy at  anytime. If we make any material change to this Privacy Policy, we will  update our web sites to include such changes and post a notice on our  home page with a link to the updated Privacy Policy. Please read any  such notice and the new Privacy Policy. Your continued use of this Site  after we post such notice will constitute your acceptance of the new  terms and their application to your use of this Site and the  information disclosed for such use, including information previously  furnished to us, as if they were the initial terms. However, we will  seek your consent if we want to use your Personal Information for  purposes other than those you have agreed to previously.
